On Thursday, September 5, the U.S. Environmental Protection Agency, or EPA, announced that it had reached a settlement with Shell (NYSE: RDS-A  ) (NYSE: RDS-A  ) for violations of the company's Clean Air Act permits at two arctic oil and gas drilling sites. In its press release, the EPA points to "numerous" violations of Shell's air permits for its Discoverer drill ship fleet in the Chukchi Sea, and its Kulluk drill ship fleet in the Beaufort Sea, both off of the Alaskan coast. Today's settlements will cost Shell $710,000 for its Discoverer violation, and $390,000 for Kulluk, totaling $1.1 million for both penalties.

Under the Clean Air Act, the permits in question set strict limits on air pollutants based on the best available control technologies. EPA initially issued the permits in January 2012, but Shell requested, in June 2012, that the emissions threshold be raised for its Discoverer fleet. Despite EPA's temporary approval for higher limits than provided in the permits, Shell still exceeded its maximum allowable levels at both sites.

The company yesterday said it will sell about 9 million units at $1.40 a unit for proceeds of about $12.6 million. Once upon a time (near the end of the Internet Bubble), telecommunications equipment stocks were the bee's knees -- the most popular kids on the block. Today, however, many of these firms are just pale reflections of their former selves. One of yesteryear's favorites, for example, JDS Uniphase (NASDAQ: JDSU  ) , once boasted a per-share price (split-adjusted) in excess of $1,050. Today, it costs a mere $13.28 -- down 98.75% from its peak.

And it's still not a buy. Here's why, in three short points:

When you stack up JDS Uniphase stock up against two of its rivals�-- Cisco Systems (NASDAQ: CSCO  ) and Finisar (NASDAQ: FNSR  ) , some interesting dynamics become apparent. First and foremost, of the three, JDS Uniphase stock is the only one �that has no P/E ratio ... because it has no "E" -- earnings -- to weigh its "P" -- price -- against.

Sure, Finisar is no bargain, either, at a price-to-earnings ratio of 170. But at least it has a positive P/E. Of the three, only Cisco has anything approaching an attractive number to its name: a P/E of 11.7.

Revenue fell 2% for the quarter, with third-party alumina sales up 10%, third-party primary aluminum sales down 10%, rolled product sales down 2%, and engineered product sales up 3%. Gross margin improved more than two points from the year-ago period, but fell more than a point sequentially. Operating income was up 65% from last year, but down almost one-quarter from the first quarter, and EBITDA was likewise stronger on a year-over-year basis (up 19%) and weaker sequentially (down 11%).

    Another stock that's starting to move within range of triggering a big breakout trade is Sky-mobi (MOBI), which, through its subsidiaries, engages in the operation of a mobile application platform embedded on mobile phones to provide mobile application store and services in the People�s Republic of China.     If you look at the chart for Sky-mobi, you'll notice that this stock recently formed a triple bottom chart pattern at $3.31, $3.28 and $3.40 a share. That move is quickly pushing MOBI within range of triggering a big breakout trade.

    Traders can look to buy MOBI off any weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support levels at $3.40 to $3.28 a share. The department store expected to post a loss for the fourth quarter and full year.

    Another earnings short-squeeze prospect is Bazaarvoice (BV), a provider of social commerce software solutions, which is set to release numbers on Wednesday after the market close. Wall Street analysts, on average, expect Bazaarvoice to report revenue of $44.12 million on a loss of 8 cents per share.

    The current short interest as a percentage of the float for Bazaarvoice is very high at 14.4%. That means that out of the 41.18 million shares in the tradable float, 6.33 million shares are sold short by the bears. The bears have also been increasing their bets from the last reporting period by 11.6%, or by 656,000 shares. If the bears are caught pressing their bets into a bullish quarter, then shares of BV could rip sharply higher post-earnings as the shorts rush to cover some of their bets.

    From a technical perspective, BV is currently trending above both its 50-day and 200-day moving averages, which is bullish. This stock has been trending sideways inside of a consolidation pattern for the last month and change, with shares moving between $10.15 on the downside and $11.50 on the upside. Any high-volume move above the upper-end of its recent range post-earnings could trigger a major breakout trade for shares of BV.

    If you're bullish on BV, then I would wait until after its report and look for long-biased trades if this stock manages to break out above some near-term overhead resistance levels at $11.35 to $11.50 a share with high volume. Look for volume on that move that hits near or above its three-month average action of 661,797 shares. If that breakout triggers, then BV will set up to re-test or possibly take out its next major overhead resistance levels at $13 to $14 a share.

    I would simply avoid BV or look for short-biased trades if after earnings it fails to trigger that breakout and then drops back below its 50-day at $10.34 a share and then below some key near-term support at $10.15 a share with high volume. If we get that m

Waterloo, Ontario-based Descartes Systems Group (NASDAQ: DSGX  ) has acquired KSD Software Norway AS, a company described as a "leading Scandinavia-based provider of electronic customs filing solutions for the European Union ('EU')."

On Thursday, Descartes -- itself a logistics technology solutions provider -- announced that it has paid $33 million to acquire KSD, a price offset somewhat by the $2 million in working capital that came with KSD. In addition to the cash, KSD brings with it a customer base of more than 1,300, most based in Scandinavia.

Edward Ryan, Chief Commercial Officer at Descartes, noted that KSD has about $10 million in annual recurring revenues. He suggested that the purchase price Descartes is paying approximates 3.1-times annual sales -- a significant discount to the 5.2x sales valuation at Descartes, proper.

Perhaps in response to the apparent good deal Descartes is getting, the company's shares rose 2.8% in Thursday trading, to close at $10.73.
